    • Mahmoud Khalil, a legal resident of the United States who was arrested by federal immigration agents on March 8 in New York City and now faces deportation, had filed a petition for a writ of habeas corpus — that’s a challenge to the constitutionality of his detention — in New York federal court. Khalil’s petition was challenged by the federal government, which asked the judge overseeing the case to dismiss it or move the case to Louisiana, where Khalil is currently detained.   • Perilous Times for Personal Liberty:

The history of human freedom is long, tortuous and not gratifying. It consists essentially in governments trampling the laws enacted to restrain them. It is the profound clash of natural personal freedom and the commands of the state backed by force. The constitutions of totalitarian countries are papered over with restraints on the state, but the restraints are toothless. The state does what it wants. It doesn’t take rights seriously.

In liberal democracies -- with the separation of powers, and checks and balances -- the state is theoretically restrained. Yet often, there, too, the restraints are paper tigers. There, too, HERE, too, the state does not take rights seriously.

Thomas Jefferson argued that in the long march of history, personal liberty shrinks and state power grows. He famously believed that only a revolution can bring about a proper reset. All of this history and theory came into sharp focus in the past two weeks when the feds arrested a Syrian graduate student in his student housing at Columbia University in New York City and shipped him to an immigration jail in Louisiana. He is married to a native-born American, they are expecting a child in April, and he is a permanent resident alien.

Last week, the federal government arrested a Lebanese physician at Logan Airport in Boston. She is a professor of medicine at Brown University, and she, too, is a permanent resident alien. The student was charged with immigration violations. The physician was summarily deported to Paris and then to her native Lebanon. The charging documents filed against the student allege no crime or personal misbehavior, point to no statutory violations, and offer no evidence of the student’s danger to persons or property or the government. The papers claim that Secretary of State Marco Rubio believes that this student’s presence on the Columbia campus -- given his outspoken support for a Palestinian state, the existence of which has been the public policy of the U.S. for generations -- is a material impediment to the execution of American foreign policy.

  • A North Dakota jury on Wednesday awarded hundreds of millions of dollars in damages to the Texas-based pipeline company Energy Transfer, which had sued Greenpeace over its role in protests nearly a decade ago against its Dakota Access Pipeline.
  • The verdict was a major blow to the storied environmental organization. Greenpeace had maintained that it played only a minor part in demonstrations led by the Standing Rock Sioux Tribe. It had portrayed the lawsuit as an attempt to stifle oil-industry critics, but a jury apparently disagreed.
    • The nine-person jury in the Morton County courthouse in Mandan, N.D., about 45 minutes north of where the protests took place, returned the verdict after roughly two days of deliberating.
    • Energy Transfer’s co-founder and board chairman, Kelcy Warren, an ally and donor to President Trump, had been outspoken in his criticism of the protesters and had the last word during plaintiffs’ closing arguments on Monday, when his lawyers played comments, he made in a video deposition for the jurors.
    • “We’ve got to stand up for ourselves,” Mr. Warren said, arguing that protesters had created “a total false narrative” about his company. “It was time to fight back.”
    • Energy Transfer is one of the largest pipeline companies in the country. The protests over its construction of the Dakota Access Pipeline drew national attention and thousands of people to months long encampments in 2016 and 2017.

  • Romanian far-right populist Calin Georgescu has been barred from participating in May's presidential election rerun by the country's Central Electoral Bureau (BEC), triggering clashes between his supporters and police.
    • Last year, Romania's constitutional court annulled November's first round of the vote - in which he came first - after intelligence revealed Russia had been involved in 800 TikTok accounts backing him.
      • The BEC rejected his candidacy on Sunday, saying it "doesn't meet the conditions of legality", as he "violated the very obligation to defend democracy".
      • Georgescu called that decision a "direct blow" to democracy. He now has 24 hours from Sunday's verdict to submit an official appeal to the top court, which should issue a ruling within 72 hours.
      • On 26 February, Georgescu was arrested on his way to register as a candidate in the summer election, prompting tens of thousands of Romanians to march on Bucharest's streetsin protest.
      • He was charged with attempting to overthrow constitutional order and membership of a neo-fascist organisation. He has denied all wrongdoing.
      • The 62-year-old independent came from nowhere to win the first round of last year's election, the results of which were annulled just days before the second round of voting.

  • Three days before President Donald Trump's inauguration, the British signed an agreement with Ukraine that includes rights to the resources, retired U.S. Army Lt. Col. Tony Shaffer told Newsmax
  • This is on the British U.K.website,"  Shaffer, the president of Project Sentinel, told Newsmax's "Wake Up America Weekend." "Ukraine and the U.K. signed a 100-year deal over security guarantees and economic development."
  • Shaffer said he believes the strong words toward Ukraine President Volodymyr Zelenskyy Friday in the Oval Office were the result of President Donald Trump and his team finding out "they were being played."
  • We, the United States, are trying to be signed up to a deal that we provide security guarantees for an economic development deal that [British Prime Minister] Keir Starmer has already signed them up to do," said Shaffer. "So the first thing it has to do is people have to take a step back and be honest with what's really going on." 
  • He added that he believes Trump was trying to play a "straight line deal" to sign an agreement on mineral rights, "knowing full well that the British had already signed on this three days before his inauguration."
  • This means that if the Europeans want the United States to continue helping them support Ukraine, "they're going to have to take a step back and start being honest with the United States about what's going on here."
  • The deal Ukraine signed with the U.K. commits the two sides to cooperate on defense, economic, and technology projects, including "supporting development of a Ukrainian critical minerals strategy and necessary regulatory structures required to support the maximization of benefits from Ukraine’s natural resources."
    • Meanwhile, Trump has been "very clear" on the Europeans' involvement in supporting Ukraine, said Shaffer. 
  • "The other day when Keir Starmer was in the office, he asked the prime minister, Gee, can you guys beat the Russians on your own? This is all about them finally stepping up and taking responsibility for their own backyard," Shaffer said. 
  • Shaffer also noted that Starmer has reportedly said that the agreements have been made between Ukraine and the U.K., but "'they're not really worth anything unless the United States shows up to make it all real.'"

Lt. Col. Anthony (Tony) Shaffer (Ret) is a Senior Fellow and President of the London Center for Policy Research and formerly a Senior Fellow of the Center for Advanced Defense Studies (CADS), and creator and producer for National Geographic's series "Chain of Command".

Lt. Col. Shaffer was awarded the Bronze Star for the first of his two combat tours to Afghanistan. He was credited for conducting highly complex operational support to NSA, and for playing a critical role in breaking the back of a Taliban counteroffensive in the fall of 2003. In addition, he was called back to active duty for DESERT STORM/DESERT SHIELD in 1991 to perform special support to Army Intelligence. He has been deployed to Thailand, Germany and New Zealand to support DoD efforts as an active duty member of the Army in addition to his Afghanistan experience.
