Welcome to DataTech Digital, LLC, doing business as DTD MEDIA, The Talk of Delmarva, WGMD, WUSX, Industry News Online, and Real News Talk (“DTD MEDIA,” “we,” “us,” or “our”). DTD MEDIA owns and operates the websites and online brands TheTalkofDelmarva.com, WGMD.com, WUSX.com, IndustryNewsOnline.com, RealNewsTalk.com, and related or affiliated websites, applications, platforms, social media accounts, usernames, handles, and domain names (collectively, the “Services”).

Definitions

“DIAL” means the Digital Interactive Audience Lounge, DTD MEDIA’s interactive audience engagement service, currently powered in part by the Mukana platform, through which listeners and users may submit questions, comments, votes, polls, messages, reactions, and other content while interacting with our programming and the Services. DIAL may be offered through the Services, Mukana, mobile applications, third-party services, or other platforms that we designate from time to time.

Certain DIAL functionality is provided through third-party technology providers, including Mukana. Information submitted through those services may also be subject to the applicable provider’s terms of service and privacy policy. DTD MEDIA is not responsible for the privacy, security, or data handling practices of third-party providers.

“Submission” means any question, comment, vote, poll response, message, chat, image, photograph, audio recording, video, attachment, reaction, emoji, suggestion, feedback, profile information, or other content submitted through DIAL or any interactive feature of the Services.

Acceptance of Terms

By accessing and using the Services, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Services.

Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Services. Your continued use of the Services following the posting of changes constitutes your acceptance of such changes.

Use of the Services

You agree to use the Services only for lawful purposes and in a manner that does not infringe upon the rights of, restrict, or interfere with any other person’s use and enjoyment of the Services or DIAL. You agree not to submit, post, transmit, or otherwise make available any content that is unlawful, defamatory, libelous, harassing, threatening, abusive, obscene, fraudulent, misleading, hateful, discriminatory, invasive of another’s privacy, or otherwise objectionable, or that infringes the intellectual property or other rights of any third party. You also agree not to upload malicious software, impersonate another person or entity, interfere with the operation or security of the Sites, disrupt the normal flow of dialogue or participation, or engage in any activity that could damage or impair the Services, DIAL, or other users’ experience.

User Submissions

When you submit any question, comment, vote, poll response, message, chat, image, photograph, audio recording, video, attachment, reaction, emoji, suggestion, feedback, or other content through DIAL or any other interactive feature of the Services (each, a “Submission”), you grant DTD MEDIA a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, transferable, sublicensable license to use, reproduce, record, broadcast, transmit, stream, display, perform, publish, distribute, edit, modify, summarize, translate, adapt, create derivative works from, archive, and otherwise exploit your Submission, in whole or in part, in any media or technology now known or later developed.

This license includes, without limitation, the right to use your Submission on our radio stations and broadcasts, podcasts, streaming services, websites, social media platforms, newsletters, mobile applications, promotional and advertising materials, printed publications, including The Patriot Weekly, and any other products, services, or media operated or authorized by DTD MEDIA.

Unless expressly stated otherwise, you should have no expectation that any Submission will remain private or confidential. Your Submission may be read on-air, quoted, published online, reproduced in print, incorporated into editorial content, or otherwise publicly distributed in accordance with these Terms.

DTD MEDIA may retain and archive Submissions, DIAL activity, chat transcripts, poll responses, votes, participation records, and other interaction logs for operational, editorial, legal, security, research, analytics, and historical purposes. Archived Submissions and interaction logs may be reviewed and used in future broadcasts, publications, including The Patriot Weekly, websites, podcasts, social media, promotional materials, or other media operated or authorized by DTD MEDIA, subject to these Terms.

We may publish or use your Submission together with your displayed name, username, screen name, account name, real name (if provided), profile information, or anonymously, in our sole discretion. We reserve the right, but not the obligation, to review, moderate, edit, shorten, summarize, combine, fact-check, translate, adapt, delay, refuse, remove, or otherwise modify any Submission for clarity, grammar, style, formatting, legal compliance, editorial standards, publication needs, or any other lawful reason. Submission of content does not obligate DTD MEDIA to publish, broadcast, respond to, or otherwise use any Submission.

We may also use automated tools, including artificial intelligence technologies, to review, categorize, summarize, analyze, or otherwise process Submissions. AI-assisted content may be reviewed, edited, or supplemented by our editorial staff before publication or broadcast.

You acknowledge and agree that you will not receive any compensation, royalty, or other payment for our use of your Submission.

Nothing in these Terms creates any obligation for DTD MEDIA to maintain the confidentiality of a Submission unless DTD MEDIA has expressly agreed to do so in writing. Users should not submit confidential, proprietary, or legally privileged information through DIAL or the Services.

By making a Submission, you represent and warrant that you own or otherwise control all rights necessary to grant the foregoing license; that your Submission is accurate to the best of your knowledge; that it does not violate the intellectual property, privacy, publicity, or other rights of any third party; and that it does not violate any applicable law or regulation. To the fullest extent permitted by applicable law, you waive any moral rights or similar rights you may have in your Submission.

DTD MEDIA also reserves the right to aggregate, tabulate, summarize, and publish the results of polls, votes, surveys, and other audience participation activities conducted through DIAL.

Editorial Independence

DTD MEDIA retains sole editorial discretion over all programming, publications, and digital content. We reserve the right to determine whether, when, how, and in what form any Submission is used. The views expressed by users are solely those of the submitting individual and do not necessarily reflect the views or opinions of DTD MEDIA, its stations, employees, hosts, advertisers, or affiliates.

Intellectual Property

All content on the Sites and or Services, including but not limited to text, graphics, logos, and images, is the property of DTD MEDIA or its content suppliers and is protected by applicable copyright and trademark laws. Unauthorized use of any content on the Services is strictly prohibited.

Third-Party Links

The Services may contain links to third-party websites that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. By using the Services, you expressly relieve us from any and all liability arising from your use of any third-party website.

Account Access and Termination

We reserve the right to suspend, restrict, or terminate access to the Services, DIAL, or any interactive feature at any time, with or without notice, for any reason, including violation of these Terms or conduct that we determine may harm DTD MEDIA, other users, our programming, or our platforms.

Indemnification

You agree to indemnify, defend, and hold harmless DTD MEDIA, its affiliates, stations, officers, employees, contractors, hosts, advertisers, partners, and service providers from and against any claims, damages, liabilities, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services or DIAL, any Submission, your violation of these Terms, or your violation of any rights of another person or entity.

Limitation of Liability

In no event shall DTD MEDIA be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

Disclaimer

The Services are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, or products included on the Services.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law principles.

Privacy Policy 

Your use of the Services may also be governed by our Privacy Policy, which is incorporated into these Terms by reference.
