Segment Topic:
-
- Federal government at war with freedom itself?
- For far too long, the federal government has expanded its reach, encroaching on the powers and prerogatives reserved to the states and the people. This centralization of authority is not only a betrayal of the constitutional system our Founders established it is a clear and present danger to the liberties we hold dear.
- Are too many Americans eager to give-up their liberties when offered no alternative by government?
The solution to this overreach does not lie in hoping for change in Washington, D.C., but in returning power to the states the original guardians of American sovereignty. As James Madison wisely counseled, the states “have the right, and are in duty bound, to interpose for arresting the progress of the evil” of any unconstitutional acts by the federal government. - The Make America STATES Again action project is designed to inspire, educate, and mobilize patriots across the country to restore the proper balance of power between the federal government and the states. Here, you’ll find the tools and resources needed to take meaningful action whether by advancing legislation in your state, educating others about state sovereignty, or championing the Constitution’s vision of limited federal government.
- What about repealing the 17th Amendment as the first step to rein in Washington sponsored tyranny?
Together, we can reclaim the freedoms that federal overreach has eroded. It’s time to Make America STATES Again. - What has Washington done to the value of the U.S. Dollar? Kevin McCallister spent $19.83 on groceries in “Home Alone.”
That same basket of Kevin’s groceries would now cost $53.95 before tax — or $52.95 with his $1-off coupon — a 167% increase over 35 years, according to calculations done by USA Today.

- Michael Finch says in his latest opinion piece in: Front Page Magazine that:
We are all now sadly aware that, in the infamous words of Barack Obama, the Left is seeking to “radically transform the United States of America.” For them to build their new heaven on earth, and attain their fantasized utopia, they must burn down the house, erase the past and wipe it clean.
- In their retelling, America’s birthday no longer is 1776, but 1619. Columbus came to this new land to execute a genocide. America is imperialistic, racist, and sexist, and these sins are baked into its founding. Hence their creation of a self-loathing iteration of American history and culture that infects so many of our citizens. The culture and history of America matter deeply. When we don’t recognize the greatness of our culture and history, when we are taught to hate our own history and myths and stories, then we fracture, we balkanize. We fall apart.
- To restore American culture, to restore Americanism, what is the responsibility of educators? Should they be held responsible for NOT teaching Americanism?
- What are the responsibilities of parents?
- We are fortunate that the path back from the Left’s malicious falsehoods lies all around us. Take to the road and discover this country anew. Read the great books, the poets, visit the State Capitols and let our great buildings inspire you. View the art that projects on canvas the very beauty and inspiration of sea to shining sea.
- Most importantly, don’t wait for our failed schools, but teach our children the essence of our nation’s greatness and beauty. The story of our nation and its people are the most fascinating and inspiring that has ever existed in human history. Be proud and embrace it, learn and teach it, and we just may survive the current and future crises that befall us. (Michael Finch/Front Page Magazine)

Show Open:
- Trump tout’s success with gasoline at or under $2-dollars a gallon!
- Gasoline rose 30-50% during Biden term.
- Why Energy Dominance is Now a National Security Imperative!
- Writing for RealClearDefense, energy expert and Power the Future spokesman Larry Behrensargues that President Trump’s newly released National Security Strategy signals a long-overdue return to seriousness in American defense by believing energy security is national security, and rejecting the idea that “climate change” and “net zero” should have any place in security planning.
- At the center of that effort is energy dominance. The strategy elevates oil, natural gas, coal, and nuclear production as top strategic priorities—linking abundant, affordable energy to good jobs, lower costs for families, a revived industrial base, and the technological edge needed for fields like AI and advanced manufacturing. A national defense built to win depends on a reliable energy system behind it.
- Europe is failing to understand this troublesome dynamic. Even though the Russian invasion of Ukraine is nearly four years old, the European Union still spent €21.9 billionon Russian energy last year or €3.2 billion more than the EU gave to Ukraine in aid during the same period. Relying on adversaries for energy is not an option for rational countries.
- In a crisis, energy becomes leverage. By expanding U.S. energy exports, the Trump Administration’s strategy strengthens our alliances and limits the ability of adversaries to pressure other nations. When our partners can buy fuel from America, they are less vulnerable to Moscow, Beijing, or Tehran.
- Our adversaries aren’t confused about their priorities. They are investing in hard power and securing energy supplies while Western governments chased “net zero” targets as if they were a strategy. This new National Security Strategy puts energy, industry, and sovereignty back at the center of defense policy and finally acknowledges that green fantasies are no substitute for steel, fuel, and deterrence.
For the first time in years, we have leadership willing to say what servicemembers, energy workers, and ordinary citizens have always known: a strong America runs on reliable energy, not slogans. (Larry Behrens/Power The Future)

- Is Blue-Slip unconstitutional?

- A federal appeals court has ruled in favor of the Trump administration’s bid to continue the deployment of the National Guard in Washington, D.C., signaling that it may find the troop’s deployment within the nation’s capital to be lawful.
- Will this decision have any effect on other cities where Trump wants to deploy the guard?

- Conservatives are champions of free speech — and they shouldn’t lose sight of that fact.
- When woke leftists wielded institutional power and squelched campus free speech, the right defended students’ and professors’ ability to say whatever they please.
- But now, a new report from the Foundation for Individual Rights and Expression shows a record number of students whose speech rights were violated, driven by a rise of conservative suppression of expression.
- The right needs to be careful not to squash the free speech it was just defending.
- FIRE’s Students Under Fire databaseshows that at least 273 students were targeted for their speech — a record breaking number that’s higher than even the depths of cancel culture in 2020.
The organization says they’ve noticed “a uptick in attempts by the political right to silence speech,” mostly by threatening to strip funding if certain students are not expelled, demanding certain groups be banned and writing executive orders to ban controversial shows or festivals.

- Delayed Pipe Bomb Arrest Reveals a Partisan Biden FBI:
- John O’Connor has always defended the FBI – not anymore!
- To be sure, various conservative commentators, prominently among them Dan Bongino, had claimed that the failure to solve the case showed that the pipe bomb was just an FBI “setup” to smear Donald Trump for January 6.
- This theory was not lacking in solid inference if one assumes a straight-shooting FBI not obstructed by a biased White House. Specifically, the Biden White House and Congressional Democrats, using their media megaphone, transmogrified the democratic January 6 protests into far more than the isolated, emotional ugliness they were. In short, the January 6 protest was an understandable populist reaction to an election for which any democracy worth its name should be ashamed. (John O’Connor)
- Back on February 5th, 2023, Bongino floated a conspiracy theory on the J6 pipe bombs.
- Bongino claimed that his source was reliable, however; Bongino wants us to believe the conspiracy evaporated when he joined the FBI.
- According to the FBI, this was NOT a fake assassination plot back on January 6th, 2021.
- Last February, Bongino assured his listeners that the J6 pipe bomb suspect was part of a conspiracy to drag Trump supporters into a double assassination attempt.

Show open and Segment Topic:
- Culpability of the Australian Government in Bondi Beach terror attack:
- Bondi Beach suspect was ‘closely connected’ to ISIS terrorist — but later dropped from monitoring.
- Judy Isaacson Elias warns that the Bondi Beach Hanukkah shooting is part of a growing wave of Jew‑hatred fueled by weak leadership and Islamist incitement, urging “good people of the world” to finally stand up and act.
- NSW Police response to the terror attack is being criticized.
- Naveed Akram, 24— who is in police custody after he and his father, Sajid, 50, allegedly killed 15 people on Sunday during a Hanukkah celebration — had been an associate of Islamic extremist Isaac El Matari (NY Post/ABC)
- Muslim Migrant from Syria disarmed one of the terrorists (Ahmed el Ahmed a fruit shop owner from Sutherland, Australia).
How does the Bondi Beach attack fits into the pattern of escalating antisemitic violence since October 7, including attempts to normalize or excuse Jew‑hatred in Western societies?
- Why moral ambiguity from governments and institutions emboldens extremists, and what true “moral clarity” from leaders would sound like right now. Have the courageous actions of the Syrian man served as a lesson to cowardice governments in the West?
- What Jewish families and communities are feeling in this moment, and why non‑Jewish allies must treat Bondi as a global wake‑up call, not a one‑day story.
- Rabbi Rabbi Pesach Wolicki: Executive Director of Israel365 Action said Islamic terror is targeting any Biblically connected religion or civilization.
- 55% of American Jews say they have been the target of Anti-Semitism in the past year!
Panelist:
Judy Isaacson Elias, Founder and Chief Executive Officer of Heroes to Heroes Foundation
9:20
Segment Topic:
- From immigration to infiltration!
- Empathy without enforcement is a security failure!
- The father of the father/son terrorist team was handed a series of visas tailor-made to provide access to the Australian homeland and permit him to create his own terrorist army in 30-years.
- They use the same method to infiltrate countries around the world, create offspring – especially in Europe, the United States and Canada. And use their offspring to wage war against the West.
- The gun-wielding father — who was killed at the scene during a shootout with police— had made three trips abroad, returning each time on a resident return visa. He entered the country on a student visa 30 years ago.
- The recent devastating attacks in Australia and at Brown are not isolated incidents or failures of empathy; they reflect a structural breakdown in how Western states govern entry, citizenship, and allegiance.
New reporting suggests that the Brown University shooter yelled “Allahu Akbar,” before opening fire at students. The police in Rhode Island REFUSE to address these claims. This claim remains unconfirmed!
This is about citizenship. When states lose the ability to define membership and enforce allegiance, violence becomes a predictable outcome, not an aberration.
Panelist:
Ammon Blair, Senior Fellow at the Texas Public Policy Foundation, is a 20+ year U.S. Border Patrol veteran, and one of the clearest voices on America’s national security and immigration.
Assimilation is not automatic. Allegiance does not arise from exposure to liberal norms alone—it requires enforceable conditions: lawful entry, credible vetting, and clear civic authority.
Modern migration is shaped by transnational criminal networks, terrorist groups, and hostile actors. Many arrivals remain embedded in coercive systems that undermine loyalty to the host state.
State collapse destroys vetting capacity. Admitting individuals who cannot be reliably identified is not compassion; it is a national-security failure.
The Somalia–Somaliland contrast shows the core truth: stability follows enforceable sovereignty and defined allegiance, not shared culture or moral appeals.
Moral vision depends on political order. Without clear boundaries and enforcement, rival loyalties and extremist networks fill the vacuum.
A temporary pause on immigration from high-risk regions is a corrective measure to restore vetting, sovereignty, and ordered liberty—not a punitive one.

Monologue:
Immediate Outrage

Segment Topic:
- Peoples Republic of California targets non-lethal weapons!
- California’s crackdown on ‘less-lethal’ weapons sparks 2A lawsuit targeting Newsom administration
- Byrna Technologies claims state violates Second Amendment by blocking ammunition sales of less-lethal weapons
- A company that sells self-defense weapons brought a lawsuit on Wednesday against Democratic Gavin Newsom‘s administration, alleging that California, a state heavy on gun restrictions, was violating the Second Amendment because it also hindered people from buying less-lethal self-defense products.
- Bryna Technologies CEO Bryan Ganz told Fox News Digital his company’s weapons, which look like handguns but shoot powerful chemical irritants rather than lethal bullets, were legal in all 50 states. But California, Ganz said, blocked sales of Byrna’s ammunition and launchers.
- “It’s easier for a Californian to get a license to carry a lethal weapon than to carry a Byrna with chemical irritant rounds,” Ganz said. “So, they’re clearly driving some people to purchase lethal weapons. So, I would say that we probably have the support of both people on the right side and the left side of the 2A debate.” (Fox News)
Panelist:
Luan Pham, Byrna’s Chief Revenue Officer
10:08
Segment Topic:
- Senate sets Obamacare subsidy vote for Thursday!
- Majority Leader John Thune confirmed yesterday that the Cassidy–Crapo plan will be brought to the floor this week. The GOP proposal would steer up to $1,500 a year into tax-advantaged HSAs paired with lower-cost plans in 2026 and 2027, rather than extending the enhanced ACA subsidies set to expire at year-end. Democrats remain committed to a three-year continuation, arguing lapse would trigger major premium spikes for millions of households.
- Brian Fitzpatrick (R-Pa.) and other GOP centrists are planning to introduce an amendment in the House Rules Committee on Tuesday that pairs a two-year extension of the subsidies with eligibility reforms, according to a House GOP staffer who spoke on the condition of anonymity.
- The average American did NOT receive any extensions back in 2009 to protect them from rising premiums and deductibles and the loss of their preferred catastrophic policies. (go to the EXCHANGE like you were told)!
- Conservatives opposed to extending the subsidies have frequently cited the cost, which is estimated to be at least $35 billion per year. (The Hill)
- The measure incorporates key provisions of a bill Fitzpatrick and Rep. Jared Golden (D-Maine) previously introduced, but it does not contain the bill’s proposed reforms to the pharmacy benefits manager industry.
- Speaker Mike Johnson (R-La.) has said he understands that moderates are worried about the politics of not extending the subsidies. But he has given no indication that he is interested in passing any such legislation.
- Isn’t this the perfect opportunity to end the Obamacare disaster?
- The Democrats deliberately created this disaster and now they want help from Republicans to fix it?
- Is the United Healthcare gravy-train coming to an end?
Panelist:
Brittany Madni is the Executive Vice President of the Economic Policy Innovation Center (EPIC). She served as a Congressional aide and trusted senior advisor for a decade on Capitol Hill, developing a nuanced understanding of the legislative process with an emphasis on budget and appropriations strategy.
10:35
Segment Topic:
Does the media hate Christmas or Christians?
The trouble with this is that as little boys and girls start growing up and find themselves swimming in a sea of “I hate Christmas” media stories some — maybe much more than some — will begin to believe these stories are not only reality but that they should be reality.
With Christianity itself beginning to fade as “the reason for the season,” Christmas can sound more like let-it-snow winter festival than a celebration of the birth of Christ.
Alas, no one has a crystal ball on something like this. But as it is at this moment, there is a serious media cavalcade out there annually pushing negative stories about Christmas. Not good. Not good at all.
The media used to be dedicated to the public good; but no more.
- The Murder of Rob Reiner: (The American Spectator/Jeffrey Lord)
“Back there in the long ago of 2017, the liberals running CNN were tired of my on-air Trump supporting, and used a tweeted joke as an excuse to push me out the door.
And to my amazement, I was quickly supported by no less than Rob Reiner and Bill Maher. I was invited to appear on Bill’s show, and there I met Rob in person on the set of Bill’s late-night show. Rob and Bill both were the epitome of graciousness, making it clear that they thought I had been wrongly dismissed.
In chatting with Rob both on and off the air, it was clear that while he was a decided liberal and I, the Trump-supporting conservative, Rob was a serious defender of free speech and absolutely willing to speak out on the subject.
Our conversations gave me the greatest respect for Rob. He was, decidedly, one of Hollywood’s most talented players. The son of another Hollywood movie and TV legend, Carl Reiner, Rob built his own quite considerable career.”
Panelist:
Jeffrey Lord, Host: Word of the Lord Podcast, Jeffrey is a Contributing Writer for NewsBusters and a contributing editor to the American Spectator

Segment Topic:
- Following a weekend of death, there is news promoting life!
- The Vatican is set to unveil and bless a historic pro-life Nativity scene this Christmas — personally blessed by Pope Leo last week.
- Shawn Carney, one of the most influential leaders in the global pro-life movement and president of 40 Days for Life, the organization whose work is literally woven into this display.
This Nativity is the visible fruit of 40 Days for Life’s global mission. The display incorporates more than 25,000 ribbons, each representing a life saved through 40 Days for Life prayer vigils and peaceful outreach this year alone. - For the first time, the Vatican is placing a visibly pro-life message at the very heart of the Christmas story, and it is doing so by elevating the real-world impact of the modern pro-life movement.
Panelist:
Shawn Carney, devout Catholic and the leader of 40 Days for Life.
11:06
Segment Topic:
- Affordability crisis and how it affects younger Americans:
- Are young couples not having children or are they terminating pregnancies because they cannot afford to have and raise a child?
- Have younger couples changed their requirements for having children (a house, high paying job, etc.)
- What about unexpected pregnancies? How many of these are terminated out of fear of finances?
- What is your advice to young couples who may be delaying to start a family?
Panelist:
Noah Brandt, Vice President of Communications at Live Action Live Action: The Digital Leader of the Pro-life Movement
We exist today to shift public opinion on abortion and defend the rights of the most vulnerable. Through compelling educational media, human interest storytelling, investigative reporting, and community activism, we reveal the humanity of preborn children and expose the abortion industry’s exploitation of women and families for profit.
11:20
Segment Topic:
- Paris Surrenders, Cancels New Year’s Eve Celebrations!
- Germany capitulates!
- Is radical Islam now in control of Europe?
Panelist:
Robert Spencer, author: Holy Hell: Islam’s Abuse of Women and the Infidels Who Enable It
11:33
Segment Topic:
- Gasoline prices are falling to levels not seen since President Trump’s first term. What effect is this having on “AFFORDABILITY” and the stability of the U.S. economy.
- This week, the U.S. House began what is slated to be two weeks of permitting action. Most notable on the calendar so far has been the passage of H.R. 3898, the “Promoting Efficient Review for Modern Infrastructure Today (PERMIT) Act,” which reforms Section 401 permitting through the Clean Water Act. Section 401 permits have long been weaponized to stop the development of natural gas pipeline infrastructure. (American Energy Alliance)
- Blue States can manipulate energy prices to their political advantage:
- The Institute for Energy Research, in partnership with Always On Energy Research, released Blue States, High Rates, a detailed new report demonstrating how state-level policy decisions shape electricity prices. The research focuses on five states – California, Florida, Louisiana, Kentucky, and New York – to illustrate how state-level energy policies affect affordability.
- Have the climate wackos lost their mojo (Bill Gates)?
- California dancing at the edge of a cliff (offshore drilling, declining refining capacity).
- The New York Post has uncoveredone of the Biden Administration’s most stunning green disasters: after spending more than $3 billion in taxpayer money to “electrify” the Postal Service, the USPS has managed to put just 612 electric mail trucks on the road. That’s not a typo. Three billion dollars. Six hundred twelve vehicles. The Post summed it up bluntly:
- “The US Postal Service has spent more than $3 billion in tax dollars on a brand-new all-electric fleet of mail trucks — and gotten just 612 vehicles for its money.”
- The rest of the fleet? A mess. More than 6,700 Ford E-Transit vans have been delivered but are sitting idle because they can’t cover rural routes or heavy loads. Oshkosh, the contractor that received the bulk of the money, has struggled so badly that early leak tests resulted in “water pouring out as if the windows had been left open in a storm.” Production has averaged three to four trucks per day. Meanwhile, USPS has quietly purchased over 26,000 internal combustion vehicles just to keep the system functioning.
- Joni Ernst is right to call this a “tremendous waste.” This was never about modernizing the fleet- it was about forcing a political project onto an essential service. And the result is exactly what you get when ideology replaces engineering: billions spent, almost nothing delivered, and taxpayers left holding the bag. If this is what “green modernization” looks like, it’s no wonder Americans are demanding real accountability, and real energy solutions that actually work. (Power the Future)
- AI data centers use about 8 times as much electricity as traditional data centers. This extra demand is already putting pressure on local grids. In Virginia, electricity bills are expected to increase by up to 25% by 2030 due to rising demand from these facilities. Have the Trump Administrations efforts so far to power AI shown any progress to date?
Panelist:
Diana Furcht-gott-Roth, Economist and Director of the Center for Energy, Climate, and Environment at the Heritage Foundation
11:50
Salute the Troops:
Sergeant Edgar Brian Torres-Tovar (Syria)

Show Open:
- The death of Rob Reiner!
- Could “Jingle Bells” be racist as Joy Reid claims?
- PBS accuses Trump of “overtly racist rhetoric.”
- The trio of PBS News Hour anchor Amna Nawaz, New York Times columnist David Brooks, and MS NOW host Jonathan Capehart assembled on Friday to attack President Trump for allegedly using “overtly racist rhetoric” at a recent speech, but nobody cared to actually specify what they found so objectionable.
- Nawaz, who just won a Walter Cronkite Award for supposedly being able to bring diverse viewpoints to the show, began with Brooks and rattled off a list of things she considered setbacks for the administration before turning the speech, “At the same time, we’re seeing a ramping up of the president’s overtly racist rhetoric. That affordability speech in Pennsylvania just devolved into an anti-immigrant, racist rant. David, are those things related?”
- Trump said many things in that speech, but two things he brought up that nobody at PBS wanted to talk about were the Somali welfare fraud scandal rocking Minnesota and the fact that Rep. Ilhan Omar “does nothing but bitch. She’s always complaining.” The welfare fraud scandal is real, and even if one wants to demand presidents use G-rated language in public, it is still true that Omar is always complaining and running down the country that granted her asylum—not to mention her frequent descents into anti-Semitism. - Late night shows go full-on revolutionary propaganda!
- Where was Jimmy Kimmel when Obama a Pelosi blew-up our healthcare system? Was Kimmel crying for us when our premiums and deductibles exploded?
- Kimmel went to the well for an expert on healthcare – he welcomed mayor Pete – who is arguably the worst cabinet secretary in this nation’s history.

- Did Mayor Pete ride his bike to the ABC studios in LA?
- Did Pete ever go to East Palestine?
- Kimmel dug up David Letterman – who now resembles Rumpelstiltskin to claim that the failed ABC late night political hit man is the leader of the resistance!
- Wikipedia and its little-known ally, Wiki Education, have quietly enlisted and trained more than 140,000 college students to build an army of activists who have already edited thousands of pages on the site, reshaping its content to push left-wing narratives, the Media Research Center has learned. - Children and a Holocaust survivor are among the 15 people killedwhen a pair of deranged gunmen opened fire on a crowded Australian beach where thousands of local Jews had gathered to celebrate the first day of Hanukkah.
- The victims range in age from 10 to 87, Australian authorities confirmed, and include religious leaders, devoted friends and beloved family members.
- But the celebratory beach outing quickly turned into terror when a hateful father and son — Naveed Akram, 24, and his 50-year-old father — showed up with shotguns, a rifle, and a car full of explosives and started shooting at anybody in sight.
- The gunmen managed to fire uninhibited for about 10 minutes, according to witnesses.
- Dead shooter was in Australia on various visas.
- Naveed (24 year old son) was finally neutralized by a courageous bystander who tackled and took him down.
- The man who took down the son was apparently a Muslim. Why do we not see more Muslims show this kind of courage?
- Naveed Akram, 24, who allegedly opened fire with his father on thousands of Jews celebrating Hanukkah Sunday night, was tagged in a February 2022 social media post praising him for mastering “all the rules of tajweed” — the recitation of laws of the Quran — at the Al-Murad Institute outside Sydney.
- “Another one of my dear students, Naveed Akram, passing the Iqra books and tajweed this morning, perfecting his all the rules of tajweed,” Adam Ismail, head of the institute, said in the since-deleted Facebook post. (NY Post/Anna Young)
Miranda Devine of the NY Post said: “And it is all so sickeningly predictable.
- Unchecked antisemitism, cowardly appeasement, lax policing and foolish immigration decisions half a century in gestation have coalesced in multicultural southwestern Sydney, an hour’s drive from Bondi.
- In the two years since the Hamas attack on Israel, synagogues in Sydney have been firebombed, kosher restaurants vandalized, cars outside Jewish homes torched and rancid antisemitic graffiti has become ubiquitous along the Bondi promenade: “Kill Jews” is the mantra.
- Every weekend for at least two years downtown Sydney is shut down by Palestinian protests.
- In August, tens of thousands of people waving Palestinian flags and wearing now-fashionable keffiyehs marched across the Sydney Harbour Bridge to demand Israel “stop the genocide” in Gaza. They were accompanied by the Sydney mayor, the former state premier, Labor members of parliament and assorted local celebrities.
- Australia now recognizes a Palestinian State!
- The intifada is now “GLOBALIZED.”
- Harrowing footage from the Hanukkah shooting in Sydney, Australia, shows a bystander tackling and disarming one of the gunmen who opened fire and killed 16 people while injuring dozens more on Sunday.
- The footage shows the bystander sneak up on the shooter as he is firing on victims off-screen. The man then tackled the shooter and wrenched the gun away from him. He then turned the weapon on the shooter, but did not fire.
- The hero has been identified by Australian media as Ahmed al-Ahmad, 43. The man’s cousin, Mustafa al-Ahmad, told Australia’s News 7 that Ahmed was shot once in the arm and once in the shoulder. The injuries came when the second gunman fired on Ahmed after he tackled the first man.

- California dancing at the edge of a cliff (offshore crilling, declining refining capacity).
AI data centers use about 8 times as much electricity as traditional data centers. This extra demand is already putting pressure on local grids. In Virginia, electricity bills are expected to increase by up to 25% by 2030 due to rising demand from these facilities. Has the Trump Administrations efforts so far to power AI shown any progress to date?

Segment Topic:
- A federal appeals court has halted U.S. District Judge James Boasberg’s attempt to probe the Trump administration’s purported refusal to comply with blocks he placed on its deportations of suspected Venezuelan gang members earlier this year.
- The decision on Dec. 12 is the latest development in an interbranch battle over such deportations by the administration. In a per curiam, or unsigned opinion, the U.S. Court of Appeals for the D.C. Circuit placed a temporary stay on Boasberg’s order requesting testimony about the administration’s decision-making.
- Kilmar Abrego Garcia, the Salvadoran who has been at the center of the Trump administration’s deportation battles, was freed from Immigration and Customs Enforcement (ICE) custody after a judge’s order on Thursday.
- S. District Judge Paula Xinis ordered ICE to immediately release Abrego Garcia and for the administration to notify the court of his status by 5 p.m.
- “Because Abrego Garcia has been held in ICE detention to effectuate third-country removal absent a lawful removal order, his requested relief is proper,” Xinis said in an opinion.
- White House press secretary Karoline Leavitt said in a Dec. 11 press briefing that the administration will file an appeal.
- “The administration opposed this activism from a judge who is really acting as a judicial activist, which we’ve unfortunately seen in many cases across the country,” Leavitt told reporters.
- A federal appeals court has removed blocks that another judge placed on Congress’s attempt to defund Planned Parenthood and other abortion providers.
- In a 3–0 decision, the U.S. Court of Appeals for the First Circuit disagreed on Dec. 12 that Planned Parenthood was likely to succeed in its legal arguments against the defunding measure. More specifically, they pushed back on the idea that the One Big Beautiful Bill Act, which was signed by President Donald Trump earlier this year, violated the Constitution’s guarantee of equal protection under the law.
- “Preventing these entities from receiving funds if they continue providing abortion services furthers Congress’s interest in reducing abortions,” U.S. Circuit Judge Gustavo Gelpí said in an opinion.
- During this week’s oral arguments in Trump v. Slaughter, Justice Sonia Sotomayor threatened America with a good time— warning that the administration is “asking us to destroy the structure of government.”
- It’s about time an unaccountable fourth branch of the state was decimated.
- Trump v. Slaughter revolves around the president’s ability to fire executive branch officials without cause at “independent” agencies.
- For one thing, nowhere does the Constitution empower Congress to create “independent” anything.
The notion is a concoction of our worst former president, Woodrow Wilson, and it was codified nearly a century ago in Humphrey’s Executor v. United States, when the high court ruled that the Federal Trade Commission was a quasi-legislative, quasi-executive, and quasi-judicial agency. (NY Post)
