Jake and the Judge
- Pre-emptive pardons
- Birthright citizenship headed to the SCOTUS for the first time?
- The battle over Tick Tock and the First Amendment!
- TikTok and the Freedom of Speech
“Congress shall make no law ...
abridging the freedom of speech
or of the press…”
--First Amendment to the U.S. Constitution
During the oral argument before the Supreme Court in the famous Pentagon Papers case, a fascinating colloquy took place between Justice William O. Douglas and the lawyer for the government. The case was about whether the government could prevent The New York Times and The Washington Post from publishing secret documents that demonstrated that American generals had been misleading President Lyndon Johnson and he had been lying to the American public during the Vietnam War.
The documents had been stolen by Daniel Ellsberg, a civilian employee of the Department of Defense, in an act of great personal courage and constitutional fidelity, and then delivered to both newspapers. Two federal judges had enjoined the newspapers from publishing the documents, and the Supreme Court was hearing appeals by the newspapers.
When Justice Douglas asked the government lawyer if the phrase “no law” in the First Amendment literally means no law, he was unable to answer. The court found his mumbo jumbo reasoning so telling that it actually published the transcript of the Q and A in the court’s opinion itself -- something it had not done before in modern times nor since.
The court ruled in that landmark case that freedom of speech and the right to know what the government is doing and the right to consult whatever source one chooses when forming an opinion each trump the government’s concerns for protection of state secrets. Thus, it matters not how the media obtains information; if it is material to the public interest, the media may publish it, without fear of civil or criminal liability.
The Pentagon Papers case was the high watermark for the freedom of speech: Freedom trumps safety. But the court studiously avoided answering Justice Douglas’ question about no law. If the Constitution means what it says, then no law literally means no law, and thus all sorts of legislation about speech -- from defamation to treason to silencing TikTok -- is unconstitutional. But if no law doesn’t really mean no law, then what does it mean?
Regrettably, today, no law means whatever the court says it means. That’s what happened last week when the court upheld congressional legislation silencing TikTok.
The legislation was based on Congress’ authority under the Commerce Clause to ban offensive products. Yet, rather than analyzing the legislation based on that, the court -- mouthing similar mumbo jumbo as the DoJ lawyer in the Pentagon Papers case -- ruled that if Congress decides that some commonly used instrument is detrimental to national security, then the court will not second guess Congress, even if this has the ancillary effect of abridging upon the freedom of speech.
This ruling, which effectively overruled the Pentagon Papers case, turns First Amendment jurisprudence on its head.
The courts have long recognized the freedom of speech as a natural human right. James Madison, who drafted the Constitution and wrote the First Amendment, understood that the right comes from our humanity. The First Amendment does not grant the freedom of speech; rather, it bars Congress from abridging it. Since the ratification of the 14th Amendment and subsequent judicial opinions, the prohibition upon interfering with speech restrains all levels of government -- federal, state and local -- and to all branches of government -- legislative, executive and judicial.
Those of us who believe that the Constitution means what it says also recognize that the freedom of speech encompasses ancillary rights -- such as the right to silence, the right to read and gather information from whatever source one chooses, and the right to transmit free speech using whatever means one chooses. Under this Madisonian view of free speech, Congress can no more tell any person how and where to express an idea than it can tell any person what to read or not read.
Yet the Supreme Court, whose principal job is to preserve personal liberty and private property from the reach of the government -- the judiciary in this respect is the anti-democratic branch of government -- utterly failed to do its job, bowing to undemonstrated congressional fears of Chinese Communist party officials hacking into the mobile devices of youthful TikTok users.
People who live in glass houses shouldn’t throw stones.
The greatest computer-hacking enterprise on the planet is the federal government’s own National Security Agency. That’s your friendly 60,000-person strong domestic spying apparatus, which unconstitutionally captures without search warrants every keystroke on every device and all data transmitted into, out of and within the United States. All of this is funded by the same Congress that will crush the free speech rights of adults because it fears foreign hacking of their children.
Do you see what has happened here? The same government that cannot audit its own Department of Defense, that can’t balance its own budget, that can’t even deliver the mail is going to protect us from the Chinese -- even if free speech is impaired in the process!
The legislation Congress enacted and that the Supreme Court upheld is profoundly at odds with basic American values. Among those values is that nothing trumps the freedom of speech. Without it, we cannot fulfill our aspirations as human beings or pursue happiness (remember that?).
This week, President Donald Trump directed his Department of Justice not to enforce the TikTok ban for 75 days in the hope of some pro-free speech resolution.
Doesn’t the Constitution mean what it says? Doesn’t no law mean no law? Isn’t the Constitution Madison gave us the supreme law of the land? The answer to all these questions is: YES. But the Constitution and its guarantees are only as vital as is the fidelity of the folks in whose hands we have reposed it for safekeeping.
In that respect, we have failed miserably.

- Pope Francis has appointed Cardinal Robert McElroy, a vocal defender of migrants and critic of Donald Trump’s first administration, as the next archbishop of Washington, DC.
- Cardinal McElroy, 70, is a strong supporter of Francis’ priorities on refugees, the environment and welcoming LGBTQ Catholics. He will succeed Cardinal Wilton Gregory, 77, who was the first African-American Archbishop of Washington, DC. (CNN 1/7/25)

Segment Topics:
- Doug Bergum, Secretary of Energy nominee’s confirmation hearing postponed today, because of some sort of paperwork snafu, however, Bergum has his work cut out for him.
- How Will Governor Doug Burgum Help Make American Energy Great Again? (American Energy Alliance)
- The Biden-Harris administration was much more extreme than even the Obama administration in trying to kill domestic oil and gas production on federal lands. In FY 2023, the Biden-Harris administration issued93% fewer leases than the Obama administration issued in FY 2009. Will you commit to leasing onshore oil and gas tracts at a level that meets or exceeds the average set during President Bush’s administration?
- In 2024, global coal use hit an all-time The United States has the largestproven coal reserves in the world. Given this continuing global demand, will you commit to continue coal leasing to help the world meet its steel and energy needs?
- The Federal Land Policy and Management Act (FLPMA) requires that BLM manage lands to maximize “multiple use” and “sustained yield.” Despite this requirement, currently only 3.3% of lands onshore are leased for oil and gas production and 0.5% of the OCS is leased. Is leasing only 1.2% of the federal estate consistent with multiple use under the Federal Land Policy and Management Act? (Onshore: 3.3% of federal lands leased: 2 million acres leased of 700 million acres. Offshore: 0.5% of OCS leased for oil and gas production. As of 2021, 12.1 millionacres were leased and, according to the Biden administration, the OCS is 2.3 billion acres).
- In yet another effort to shut down oil and gas production on federal lands, the Biden administration made it substantiallymore expensive to operate, increasing royalty rates and disproportionately hurting America’s smaller, independently owned companies (those who employ an average of 15 people). Will you commit to jettisoning the Biden royalty rate increases as a way to encourage more American energy production and make it possible for small and start-up businesses to participate once again?
- It has recently come to lightthat the Endangered Species Act (ESA) was deliberately abused in an effort to halt the construction of the Tellico Dam by the Tennessee Valley Authority. We should also not forget how the ESA was infamously used to kill the timber industry by way of the spotted owl, and, along with it, tens of thousands of jobs in the Pacific Northwest. The egregious exploitation of the ESA has been used countless times to stop American progress. What will you do to stop the abuse of the ESA?
- Last year the Biden administration finalized their “Public Lands Rule.” This was designed to eviscerate the multi-use requirements of the Federal Land Policy and Management Act (FLPMA). Will you review this regulation and take appropriate steps to promote the requirements of the Federal Land Policy and Management Act (FLPMA)?
- A poll foundthat 88% of voters believe it is important to produce natural gas and oil in the United States; 90% believe producing natural gas and oil strengthens the U.S. economy; and 85% believe that producing natural gas and oil in the United States helps make it more secure against actions by countries such as China and Russia. What concrete steps can you take to ensure the will of the American people is followed and federal lands continue to be used for energy production?

- The release of Jack Smith’s Report:
- Jack claims that Trump would have been convicted.
- Prosecution without a defense?
- Prosecution without the possibility of rebuttal?
- Should reports such as these where there was no trial, no conviction ever be released?
- Special counsel David Weiss, who successfully prosecuted first son Hunter Biden on tax fraud and gun charges, slammed President Biden’s criticism of his investigation as “gratuitous and wrong” in a report on the years-long investigation released Monday.
- “Other presidents have pardoned family members, but in doing so, none have taken the occasion as an opportunity to malign the public servants at the Department of Justice based solely on false accusations,” Weiss wrote in his 27-page report. (NY Post)
- Back in 2018, John D. O’Connor penned an opinion piece for the Daily Caller: “Ecological Sustainability Enabled California’s Ecological Armageddon.”
- The truth is as ugly as it is undeniable: well-meaning environmental absolutists preaching “ecological sustainability” have hamstrung important, truly ecologically sustainable activities such as timber harvesting, salvage for insect infestation, controlled burns and other time-tested management practices.
- When forests burn, all sequestered carbon dioxide is released, along with other poisons such as nitrogen oxide (acid rain) and carbon monoxide. One-million six-hundred acresof California forest, burned just in 2018 alone, emitted, at an estimated 450 trees-per-acre, approximately 700 million tons of carbon dioxide, or about six times as much carbon dioxide emitted annually by all the autos in the state.
- John, what kind of political damage have the fires in the Southland done to Gavin Newsome?
- John, what did it look like to the Los Angeles media that a British journalist from Sky News had to pepper Karen Bass on a Jetway with questions about her trip to Ghana – rather than local Los Angeles media?

- A Post-'Defund the Police' World Made New Orleans a Soft Target!
- While law enforcement looks for possible connections to international groups, there is a domestic factor closer to home that may also be a contributing factor: the post-George Floyd, "Defund the Police" movement which has stripped cities of much-needed on-duty police officers.
- More than four years after the "defund the police" movement took hold, New Orleans has been suffering from a police shortage crisis.
- In 2023, the New Orleans police force was operatingjust above 50% capacity — at just 900 officers on a force that once had 1,600 officers.
- In fact, the city of New Orleans became so concerned about the shortage of police officers that in the last two years it has recruited civilians to serve as officers to respond to things such as non-injury car accidents.
- Funded by the French Quarter Economic Development District, the Supplemental Police Patrol Program (“SPPP”) proactively patrols the French Quarter streets to help the New Orleans Police Department deter crime. It uses a mobile application that allows businesses, residents, visitors, and employees to easily report crimes in progress. The SPPP patrols 24 hours a day, 7 days a week. The initiative has been credited by the N.O.P.D. as having a positive impact on violent crime, including the removal of guns, drugs, and criminals from the French Quarter.
- Policing watchdogs are raising caution flags, however. Previous actions by state troopers in the French Quarter, working alongside New Orleans officers who operate under different rules set by a federal consent decree, sparked allegations of excessive force and racial profiling, lawsuits and concerns over transparency. (French Quarter Management District)
- Jeff Landry announces he wants permanent state trooper presence in New Orleans in January 2024!
- Troop (NOLA) returns to the French Quarter in February 2024!
- Did the Republicans learn anything from the Mike Johnson debacle?
- Did those who refused to vote for him lose the support of President Trump?
- How much damage has Kathy Hochul done to the future of the Democratic machine in New York with this Congestion Pricing scheme?
- Are Republicans poised to take back control of Albany and NYC?

- Killing the Constitution at GITMO (Judge Andrew Napolitano 1/9/25):
When British kings wanted to dispose of troublesome enemies -- real or imagined -- they often had them or their colleagues arrested on pretextual charges and then brutally tortured until confessions were extracted. The confessions were then read aloud during so-called trials; and, of course, the defendant was convicted of whatever crime was the subject of the confession.
All this was done in order to satisfy the political, and in many cases the personal, desires of the monarch by creating the impression of due process.
Often the torture occurred in remote places, so remote that there was no government there, and the king and his counselors could argue that the protections of the British traditions of fair play -- the British do not have a written Constitution, but rather a set of traditions -- was not violated because the torture occurred in a place where the traditions did not apply.
When one of the victims of this practice was an official who had previously engaged in perpetrating it, the House of Commons, many of whose members feared becoming victims of the monarch’s desires, adopted the principle of habeas corpus. That ancient right compelled the jailer of any person anywhere to bring the jailed person before a neutral magistrate and justify the confinement.
Due process has numerous definitions and aspects, but for constitutional purposes it basically means that all charged persons are presumed innocent and entitled to a written notice of the charges, a speedy and fair hearing before a neutral fact finder, a right to appeal; and the entire process imbued with fairness and a profound recognition of personal innocence until guilt is proven beyond a reasonable doubt. Due process also explicitly prohibits the use of torture.
In order to ensure that due process and habeas corpus would trump the whims of government officials -- stated differently, to ensure that the British system of torture and confession and conviction did not occur here -- James Madison and the Framers crafted protections in the Constitution to which all in government needed to swear allegiance and support.
Fast forward to the United States Naval Base at Guantanamo Bay, Cuba, and you can see the constitutional system turned on its head.
This George W. Bush-crafted American Devil’s Island, which costs $500 million a year to operate, once held 780 prisoners, allegedly there due to their personal involvement in the war on terror against the United States. Not a single one of them has been convicted of 9/11-related crimes, and only one former detainee is currently serving time in an American federal prison.
Nearly all the prisoners were tortured, and most were captured by roving militias and sold to American forces for bounties. Last week, under cover of darkness, the Biden administration released 11 detainees, all of whom had been at Gitmo for 20-plus years and none of whom had been charged with a crime.
The best known of the remaining 15 prisoners is Khalid Sheikh Mohammed, whom the government claims was the mastermind of 9/11. Mohammed was scheduled for trial when the military judge in his case retired. The new judge -- the fifth on the case -- was confronted with the daunting task of reading 40,000 pages of transcripts and documents concerning the torture of Mohammed by U.S. personnel.
At the same time, a new team of military and civilian prosecutors was assigned to the case and the new prosecutors told their bosses in the Pentagon and the new military judge that unlike their predecessors -- who sought to mitigate the 183 torture sessions U.S. personnel administered to Mohammed -- they were prepared to acknowledge it and decline to use any evidence obtained from it in the courtroom.
This remarkable turnaround -- one that rejected the premises upon which Gitmo came into being -- resulted in the prosecutors commencing plea negotiations.
The Bush-inspired premises of Gitmo were that since it is located in Cuba, federal laws don’t apply, the Constitution doesn’t apply and federal judges can’t interfere. In five landmark decisions, the Supreme Court rejected all these premises, and the new team of prosecutors and the new judge recognized as much.
The prosecutors basically said that they cannot ethically defend torture, they will not offer evidence derived from it in the case, and the case is difficult to prove without evidence derived from torture. This is a remarkable lesson to be learned. Instead of cutting holes in the Constitution, follow it. Instead of using torture, use acceptable investigative techniques. Instead of crafting a Devil’s Island, use the systems in place that have basically worked.
The settlement negotiations produced an agreement for a guilty plea that removed the death penalty from the case, required Mohammed to answer truthfully all questions put to him under oath and in public by prosecutors, defense counsel and lawyers for 9/11 victims’ families, and life in prison at Gitmo; not America’s hellhole in Florence, Colorado.
The plea was approved in writing by all, including the retired general in the Pentagon in charge of Gitmo prosecutions -- herself a former military appellate judge. When Secretary of Defense Lloyd Austin learned of the plea agreement, he instructed the military prosecutors to move to vacate the agreement they had instigated. The trial judge denied this unique request. Last week, a military court of appeals upheld that denial. Mohammed’s courtroom plea will now take place before President Joe Biden leaves office.
None of this jurisprudential mess would have occurred if Bush had allowed the criminal justice structure to proceed unimpeded. The use of torture, rotating judges and prosecutors, and incarceration for 20 years without charges or trial are all hallmarks of an authoritarian government. If justice consists in convicting the guilty using established norms and fair procedures, Gitmo has been an unjust unhumanitarian disaster. But if justice consists in the king getting whatever he wants, then the Constitution is useless as a protector of freedom.

Jimmy Carter Making Terror Great Again:
Ok Jimmy Carter died. Many will fill volumes writing now that he was a good guy, honest, smart, did some good things as president, and in his post presidency. Despite many of these things being true, to me Carter was an unrepentant anti-Semite who made excuses for Arab aggression and terror against Israel, and empowered the terrorists whose goal to annihilate Israel and the Jewish people are no less part of Carter’s legacy. For that alone and using the pulpit of his presidency in exile to spread these messages, I say good riddance.
As a failed one term president despite some achievements including helping to broker the Camp David peace agreement with Israel and Egypt, Carter’s abysmal policies vis a vis Iran left the US ally Shah Mohammed Reza Pahlavi overthrown by Islamists, himself dying in exile, paving the way for the Islamic Republic regime to take over Iran which it has hijacked for the past 46 years. The Iranian hostage crisis was an example of Carters weakness and underscored by the fact that the hostages were released the day Carter was out of office.
His ineptitude was on full display then and paved the way for the Iranian Islamic regime to become the world’s largest state sponsor of l terror. These are not mere words. Millions of Israelis and Iranians as well as Jews and others are still suffering as a result.
Even Carter suffered. Since 1981 he mourned the murder of his friend Egyptian President Anwar Sadat, gunned down by Iranian inspired Islamic terrorists. Nevertheless, rather than blaming the ayatollahs, Carter missed no opportunity to blame Israel for something.
Carter’s antisemitism was not only unrepentant but arrogant as if only he knew the truth, but his truth was a cocktail of distortions and fantasy, looking at the Middle East through a prism about how he thought things should be rather than how they were.
His book “Palestine Peace Not Apartheid” remains part of Carter’s antisemitic legacy. He deliberately retained and justified his own legitimization of terrorism against Israel despite being called out as such, offering no apology, no correction, no recall: just a playbook about why killing Jews was OK.
Carter wrote, "It is imperative that the general Arab community and all significant Palestinian groups make it clear that they will end the suicide bombings and other acts of terrorism when international laws and the ultimate goals of the 'Roadmap' for peace are accepted by Israel."
Basically: as long as Israel doesn’t do what Carter thinks it should do, terrorism against Israel will continue and is legitimate.
As for propping up the terrorists, Carter not only was among the first to give credibility to Arafat and the PLO, but also Hamas. One has to wonder if, like the terrorists, Carter thought the Hamas massacre of October 7, 2023, was indeed legitimate “resistance,” or if he ever reconsidered his flawed views. We’ll never know, but what we do know is that he never said the later. So, all we have to go by is his justifying and legitimization of terror.
Carter doubled down on his anti-Israel rhetoric and hate as a leading member of “The Elders,” a group of failed world leaders who colluded in multiple ways to continue his anti-Israel diatribe. The Elders were so antisemitic that one could even ask if they were the authors of “The Protocols of the Elders of Zion,” or just devoted followers.
In 2009, Carter visited my neighborhood, Gush Etzion, where he surprised many my stating that in an eventual two state solution (creating a Palestinian Arab state in Judea and Samaria- the “West Bank” and Gaza), he did not envision that Israel would have to return places like this. "I never imagined that Gush Etzion would be transferred to Palestinian hands.”
Maybe he misspoke or was just making friendly chit chat, but the praise he received then for looking at the reality and not stringent black and white policies in which Israel was always to blame was short lived and not repeated. He must have realized that legitimizing Israeli “settlements” in any way complicated his notion that it was still OK for Palestinian Arab terrorists to kill us.
Carter repeatedly blamed he Jews both for voting for Ted Kennedy in his unprecedented primary campaign against a sitting president, and then losing to Ronald Reagan. To him the Jews were disloyal if not all powerful (i.e. Protocols). Unencumbered after living at 1600 Pennsylvania Ave., Carter simply allowed his antisemitic tendencies to take prime time in his Emory University Carter Center.
It never escaped me on my visits to the Carter Center that many of the top donors were anti-Israel Arab leaders, raising the question as to whether Carter’s views were formed by his benefactors, or if the benefactors raced to lay the foundation for a place in which their views were at home with Carter.
As a student at Emory in the 1980s, where his failed presidency found refuge, I had several interactions with Carter, mostly lecturing in different classes. Yes, he was charming, and his soft-spoken demeanor lent one to think he was a good guy.
One day in 1988, I attended an event where he made public remarks following another trip throughout the Middle East where he had no problem cozying up to the original Assad dictatorship and other terror leaders. His public comments throughout the trip were a dizzying litany of anti-Israel comments, throughout the Arab capitals where he was feted, and when he was in Israel. Basically, he blamed Israel for everything wrong and the lack of peace in the Middle East.
During the question and answer, there was time for one question and my hand shot up. It was the week of the anniversary of the Camp David accords, and I thanked him for helping to make that possible to which he responded with his big peanut smile. Then I asked him if, as a representative of Emory University, was it not academically disingenuous to travel the world and blame Israel for lack of peace while not holding the Arabs at least equally accountable.
His peanut smile turned to a scowl, and he began a tirade about how I was wrong, and Israel is to blame. I never had a former president get angry at me and “rip me a new one.”
It felt good not because I upset him, but because I called him out in public for his dishonesty and he had no good answer other than perpetuating his biased rate which was on full display.
Carter had been in hospice care for a very long time and his death was inevitable. From my perspective, long overdue. I ask myself why God gives people like this who have such evil in their hearts so many extra years. My only explanation, or rationalization, is maybe God was giving him a chance to repent, and Jimmy Carter needed that many more years to do so.
I’m not convinced that he did repent, and while it would be inappropriate to throw the baby out with the bathwater and suggest that he never did anything good, which would be dishonest, he was a failed one term president, and he did unambiguously call for and justify the terrorist murder of my people. That disqualifies him from sainthood or many of the other honors and memories that others are sharing and will share in the days to come.
At least in remembering his life, let us remember that he at least indirectly caused tremendous pain and suffering, and death for which building houses for poor people is no redeeming compensation.
